Resumen
The objective of this work is to analyze the real and effective protection of the State to the victims of intrafamily violence as subjects of special protection: women and minors, in pandemic contexts, trying to show the problems raised from the confinement, the measures of protection taken by the State, and its review of constitutionality control, to later establish the effectiveness of the measures adopted. This is a qualitative research with a hermeneutical approach, which aims to describe, understand and interpret reality, social groups and individuals, in the context of social processes – family violence, isolation measures, Covid-19 pandemic, institutional care measures –, through the interpretation of singular phenomena: theories, legal norms, judicial decisions, institutional decisions. It is concluded that although the legislative measures adopted to avert the crisis could be a not only to solve the proposed problem, but also to correct the problems of yesteryear that accompany the institutionality, solutions that go beyond a formalistic approach without clear effectiveness, since it does not include the budget and capacity allocation necessary to deal with the crisis.
